29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) On or about February 8, 2021, the employer did not ensure that each employee(s) engaged in residential construction activities 6 feet or more above lower levels were protected by guardrails, safety nets, or personal fall arrest systems. Employees of M.J. South Construction, LLC., were exposed to fall hazards of up to 24 feet, while engaged in residential framing activities. Employees were not using fall protection equipment. 29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:   (a) On or about February 8, 2021, the employer did not ensure that portable ladders used to access an upper landing surface had side rails that extended at least 3 feet above the landing surface. Employees of M.J. South Construction, LLC., were exposed to fall hazards of up to 10 feet, while using a ladder that did not extend at least 3 feet  past the landing surface and was not secure to the structure. 29 CFR  1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:     (a) On or about February 8, 2021, the employer did not ensure that ladders were only used for purposes for which they were designed. Employees of M.J. South Construction, LLC., were exposed to fall hazards of up to 10 feet, in that they used a folded A-Frame ladder as an extension ladder to access the top plate while conducting framing activities in a residential building.
