29 CFR  1926.50(c): In the absence of an infirmary, clinic, hospital, or physician, that is reasonably accessible in terms of time and distance to the worksite, which is available for the treatment of injured employees, a person who has a valid certificate in first-aid training from the U.S. Bureau of Mines, the American Red Cross, or equivalent training that can be verified by documentary evidence, shall be available at the worksite to render first aid.   On February 2, 2021 at E8069 Romberg Drive in New London, the employer did not ensure certified medical first aid treatment was available within four minutes for construction site employees working at heights greater than ten feet above a concrete surface.

29 CFR  1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section.   On February 2, 2021 at E8069 Romberg Drive in New London, the employer did not ensure a scaffold platform used by an employee to work at thirteen feet above surface level had been designed by a qualified person.  The basket platform did not have a capacity label, a means to securely attach the platform to the lifting mechanism, a means to retain it against the vertical face of the forks, a slip resistant floor, or a four inch toe plate.

29 CFR  1926.451(c)(2)(iv):  Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.  On February 2, 2021 at E8069 Romberg Drive in New London, an employee who was installing ceiling joists was working from an Intermediate Bulk Container (IBC) cage supported by a Volvo Wheel Loader thirteen feet above surface level.

29 CFR  1926.451(f)(3): Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.   On February 2, 2021 at E8069 Romberg Drive in New London, the employer did not ensure a competent person inspected the Economy scissor lift scaffold prior to employees working from the platform at fifteen feet above surface level.  The control box emergency stop switch was missing, labeling for the three way key was missing, pilot light was missing, selector handle's safety device lock ring was missing, original steering switch was missing and a non-original toggle switch was added, and the control, operation, and warning decals were missing.

29 CFR  1926.452(w)(6)(i):  Employees shall not be allowed to ride on scaffolds unless the surface on which the scaffold is being moved is within 3 degrees of level, and free of pits, holes, and obstructions.   On February 2, 2021 at E8069 Romberg Drive in New London, employees were riding on a scissor lift platform extended twelve feet above concrete surface in an area with an unsecured cover on a floor drain.

29 CFR  1926.454(a)(1):  The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the nature of any electrical hazards, fall hazards and falling object hazards in the work area.   On February 2, 2021 at E8069 Romberg Drive in New London, the employer did not provide required scaffold safety training for employees working from mobile scaffold platforms exposed to potential fall hazards greater than ten feet.

On February 2, 2021 at E8069 Romberg Drive in New London, the employer did not provide required scaffold safety training for employees operating mobile scaffold equipment exposed to potential fall and struck by hazards during ceiling joist installation.

29 CFR  1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.   On February 2, 2021 at E8069 Romberg Drive in New London, an employee fell from an elevation and was admitted to a hospital.  The employer did not report the incident.
