29 CFR 1926.1126(c):The employer did not ensure that no employee was exposed to an airborne concentration of chromium (VI) in excess of 5 micrograms per cubic meter of air calculated as an 8-hour time-weighted average (TWA): a. On or about April 13, 2021, an employee was exposed to airborne levels of hexavalent chromium at an 8 hour time weighted average level of 8.43 �g/M3, approximately 1.7 times the OSHA 8-hour time weighted average permissible exposure limit of 5 �g/M3. This permissible exposure limit is established to prevent irritation of the respiratory system, skin, and eye injuries, as well as lung cancer, asthma, nasal perforation and ulceration, and dermatitis. The exposure level was derived from a sample taken over a 440 minute period during one shift on April 13, 2021. Zero exposure was assumed for the unsampled period of 40 minutes.

29 CFR 1926.1126(d)(3): The employer did not determine the 8-hour time-weighted average exposure for each employee on the basis of any combination of air monitoring data, historical monitoring data, or objective data sufficient to accurately characterize employee exposure to chromium (VI): a. On or about February 10, 2021, the employer had relied on historical air monitoring data from previous project worksites in 2009 and 2015 with follow-up air monitoring in 2016 and 2017. The 2009 air monitoring report indicated that weather conditions were abnormal the day of monitoring and, therefore, should be repeated. The employer completed air monitoring in mid-February 2015 where 4 of 14 results obtained indicated employee exposures of 66.7, 674, 134, and 711 �g/m3, which were above the OSHA PEL of 5 �g/m3. The employer repeated air monitoring at the end of Feb 2015, which indicated an employee exposure of 13 �g/m3, and again in December 2016, which indicated employee exposures of 9.3 �g/m3 and 22 �g/m3. Monitoring in January and February 2017 was also obtained with one employee exposure 3.4 �g/m3, which was above the OSHA Action Level of 2.5 �g/m3. No air monitoring had been completed by the employer at the Guernsey Power Station worksite prior to February 10, 2021.
