29 CFR 1926.251(a)(1):Rigging equipment for material handling shall be inspected prior to use on each shift and as necessary during its use to ensure that it is safe. Defective rigging equipment shall be removed from service. a. On or about February 11, 2021, located at 289 Harness Way, Lot 750, Lewis Center, Ohio, a nylon strap was used to hoist assembled trusswork from below the tines of a rough-terrain forklift. The nylon strap had its two ends tied together and was no longer safe for use. The employer did not remove the defective rigging from service, thereby exposing the employees to a struck-by hazard.

29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. On or about February 11, 2021, located at 289 Harness way, Lot 750, Lewis Center, Ohio, employees were installing trusses without any means of fall protection, thereby exposing the employees of a fall hazard of approximately 13 to 23 feet. b. On or about February 11, 2021, located at 289 Harness Way, Lot 750, Lewis Center, Ohio, there was an unprotected floor hole that had a 5 foot 6 inch opening without guardrails on one end and a 4-foot opening on the other end without guardrails. The employees were exposed to a 9 foot fall hazard.

If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced. a. On or about February 11, 2021, located at 289 Harness Way, Lot 750, a rough-terrain forklift was used to lift assembled trusswork for installation. The lift was a below-the-tine lift which modified the equipment's centerline affected the safe operation of the equipment, thereby exposing the employees to a struck-by hazard.
