29 CFR 1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. a. On or about February 12, 2021 and at times prior, the employer failed to initiate/maintain a safety and health program such as but not limited to a fall protection program to ensure detection and correction of hazards during construction activities. Hazards were not identified and/or corrected onsite prior to employees and sub-contractor employees performing HVAC work on the roof of a new build commercial building. This exposed employees to falls of over 14 feet.

29 CFR 1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a. On or about February 12, 2021 and at times prior, the employer failed to train employees on the hazards found on the worksite or the procedures to control or eliminate the hazards for employees performing HVAC work on the roof of a new build commercial building at heights of over 14 feet without proper fall protection. The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to their environment to minimize risk of injuries.

29 CFR 1926.451(c)(2)(iv):Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use. a. On or about February 12, 2021, the employer permitted a sub-contractor employee to work from a glass/window carrier that was being used as a scaffold platform. The scaffold platform was being supported on the tines of a New Holland Rough Terrain Forklift (model number LM860CTPTMR, Serial No: 041718384). The scaffold platform was not approved by the manufacturer to lift personnel. By permitting the sub-contractor employee to work from the platform, the employer exposed the employee to a fall hazard of over 14 feet to the ground level.

Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems. a. On or about February 12, 2021, the employer did not ensure that sub-contractor employees and employees engaged in commercial construction activities were adequately protected from falls. Employees were performing HVAC work on a steep roof of a new build commercial building at heights of over 14 feet without appropriate means of fall protection.
