29 CFR 1917.27(a)(1): Only those employees determined by the employer to be competent by reason of training or experience, and who understand the signs, notices and operating instructions and are familiar with the signal code in use shall be permitted to operate a crane, winch or other power operated cargo handling apparatus, or any power operated vehicle, or give signals to the operator of any hoisting apparatus. Exception: Employees being trained and supervised by a designated person may operate such machinery and give signals to operators during training. a) On or about February 8, 2021, the employer did not ensure that the barge employee who had given signals to the operator of the crane operator had been sufficiently trained as the employee had given incorrect signals and had signaled for the load to be moved when the barge was not secured.

29 CFR 1917.112(a)(1): Vehicle curbs, bull rails, or other effective barriers at least six inches (15.24 cm) in height shall be provided at the waterside edges of aprons and bulkheads, except where vehicles are prohibited. Curbs or bull rails installed after October 3, 1983, shall be at least 10 inches (25.4 cm) in height. a) On or about February 19, 2021, there were no vehicle curbs or bull rails present. Vehicles such as the Manitowoc crawler crane and forklifts worked on the dock removing cargo from the barges.

29 CFR 1910.1200(e)(1):Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following: 1910.1200(e)(1)(i) A list of the hazardous chemicals known to be present using a product identifier that is referenced on the appropriate safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas). a) On or about February 19, 2021, the employer was unable to provide the written hazard communication program or hazardous chemical list for chemicals such as penetrating oil (skin sensitizer, flammable) which is used on the wire ropes and pendant of the crawler crane.
