29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) At the jobsite, employees were installing plywood sheeting and framing a 5/12 sloped roof area of a residence. Employer did not provided fall protection training to the employees, exposing the employees to a fall hazard of approximately 10', on or about February 12, 2021.

29 CFR  1926.1053(b)(1):Where (a) portable ladder(s) was/were used for access to an upper level landing surface the ladders length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.  a) At the jobsite, on the left front side of the residence (south east side) a portable ladder was being utilized in which it did not extend 3 feet above the roof's edge, on or about February 12, 2021.  b) At the job side, on the back left side of the residence, a portable ladder was being utilized in which it did not extend 3 feet above the roof's edge, on or about February 12, 2021.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a)  At the job site, employees were exposed to fall hazards of approximately 10 feet, while conducting framing/decking work on a 5:12 pitch roof without fall protection, on or about February 12, 2021.  (b) At the job site, an employee were sitting on a elevated wall at  approximately 13 feet without fall protection, on or about February 12, 2021.  Arellano Imperial, Inc was previously cited for a violation of this occupational safety and health standard , which was contained in OSHA inspection number 1478072, citation number 1, item number1  and was affirmed as a final order on 9/8/2020 , with respect to a workplace located at Toscana Isles, 171 Pescadora Place, Nokomis, FL 34275.
