29 CFR 1926.453(a)(2): Field modification of the aerial lift was not certified in writing by the manufacturer or by any other equivalent entity, such as a nationally recognized testing laboratory, to be in conformity with all applicable provisions of ANSI A92.2-1969 and this section and to be at least as safe as the equipment was before modification. On or about February 19, 2021, an aerial lift was modified with boards to store wall panels without being certified by the manufacturer or equivalent entity, such as a recognized laboratory, to be in conformity with all applicable provisions of ANSI A92.2-1969. This condition exposed employees to fall and strike-by hazards from heights over 6 feet from lower level.

29 CFR 1926.454(a)(3): The employer did not train each employee who performs work on a scaffold, by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards, including the proper use of the scaffold and the proper handling of materials on the scaffold: On or about February 19, 2021, employees who used a suspended scaffold to install panels were not trained on the proper use of the scaffold. This condition exposed employees to fall hazards greater than 6 feet.
