29 CFR 1910.134(k)(1): The employer did not provide effective training that covered the required elements in 1910.134(k)(1)(i) - (vii):  a) Maplewood Nursing & Rehabilitation Center located at 125 West School House Lane, Philadelphia, PA 19144:  On or about January 1, 2021, and continuing thereafter, the employer did not provide employees with effective training related to respiratory protection, including the importance of seal check and effects of improper fit, limitations, maintenance and care, and medical signs and symptoms preventing effective use of filtering facepiece respirators. The employer required employees to wear N95 filtering facepiece respirators to protect against SARS-CoV-2 while providing care to suspected and confirmed positive COVID-19 residents.

29 CFR 1904.4(a): The employer did not record each work-related illness that resulted in the general recording criteria on the OSHA Form 300 or equivalent:  Maplewood Nursing & Rehabilitation Center located at 125 West School House Lane, Philadelphia, PA 19144:  a) On or about December 28, 2020, the employer did not record work-related illness on the OSHA 300 log or its equivalent. An employee was hospitalized on December 21, 2020 as a result of a confirmed case of COVID-19.   b) On or about December 26, 2020, the employer did not record a work-related COVID-19 illness of an employee on the OSHA 300 log or its equivalent. A Certified Nursing Assistant assigned to work with COVID-19 positive residents tested positive for COVID-19 on December 19, 2020.  c) On or about January 5, 2021, the employer did not record a work-related COVID-19 illness of an employee on the OSHA 300 log or its equivalent. A Licensed Practical Nurse assigned to work with COVID-19 positive residents tested positive for COVID-19 on December 29, 2020.

29 CFR 1904.5(a): The employer did not consider an injury or illness to be work related when the event or exposure in the work environment caused or contributed to an existing condition or significantly aggravated an existing injury or illness:  Maplewood Nursing & Rehabilitation Center located at 125 West School House Lane, Philadelphia, PA 19144:  a) On or about December 19, 2020, and continuing thereafter, the employer did not determine if COVID-19 illness was caused by a work related exposure. Employees such as Registered Nurses, Certified Nursing Assistants and Licensed Practical Nurses tested positive to COVID-19 after providing direct care to COVID-19 positive residents.
