29 CFR  1910.134(c)(2)(ii): In addition, the employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks).  On or about February 19, 2021, Range Safety Officers were exposed to respiratory stressors while being allowed to wear 3M 1/2 face tight fitting respirators while cleaning and/or vacuuming the gun range area and the employer did not establish and implement elements of a written respiratory program that ensured employees using a respirator voluntarily were medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so it does not present a health hazard to the user.  Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR  1910.134(e)(1):  The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.  On or about February 19, 2021, Range Safety Officers were exposed to respiratory stressors while being allowed to wear 3M 1/2 face tight fitting respirators while cleaning and/or vacuuming the gun range area and the employer did not provide medical evaluations for employees prior to respirator use.   Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR  1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  On or about February 19, 2021, Range Safety Officers were exposed to respiratory stressors while being allowed to wear 3M 1/2 face tight fitting respirators while cleaning and/or vacuuming the gun range area and the employer did not provide basic advisory information on respirators, as presented in Appendix D of the standard in in written or oral format to employees who voluntarily wear respirators.   Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR  1910.1025(d)(2):An initial determination was not made to determine if any employee may be exposed to lead at or above the action level:  On or about February 19, 2021, Range Safety Officers were potentially being exposed to lead hazards while performing tasks such as, but not limited to, cleaning and/or vacuuming the gun range area  and the employer did not perform initial air monitoring to determine if employees were exposed to lead levels at or above the action level.   There is no abatement certification or documentation required for this item.
