29 CFR 1910.178(p)(1):Powered industrial truck(s) with defect(s) or in any way unsafe had not been withdrawn from service until restored to safe operating condition(s): a) Plant 1, Production Department - On or about 2/22/2021, the clasp used to secure a (LP) gas cylinder on the company's fork truck was broken. The company did not ensure that the deficient condition was corrected before allowing the company's Mitsubishi (LP) fork truck, model # FGC25N and serial # AF82F00798 to be used by employees. Operators and/or employees working in the immediate area were not protected from struck-by hazards in the event that an operator(s) were to take a sharp turn or hit a bump, causing the cylinder to become dislodged or hit the ground and potentially become a projectile.

29 CFR 1910.1200(a)(1):The purpose of this section is to ensure that the hazards of all chemicals produced or imported are classified, and that information concerning the classified hazards is transmitted to employers and employees. The requirements of this section are intended to be consistent with the provisions of the United Nations Globally Harmonized System of Classification and Labelling of Chemicals (GHS), Revision 3. The transmittal of information is to be accomplished by means of comprehensive hazard communication programs, which are to include container labeling and other forms of warning, safety data sheets and employee training: a) Plant 1 & Plant 5, Production Department - On or about 2/22/2021, the employer exposed employees to burn injuries and fire hazards in that the employer failed to ensure that comprehensive hazard communication program to be consistent with the provisions of the United Nations Globally Harmonized System of Classification and Labelling of Chemicals (GHS), Revision 3 was provided to employees working with hazardous chemicals such as, but not limited to Propane while operating LPG Mitsubishi forklifts.
