29 CFR  OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a hazard of falling off the raised forks of a powered industrial truck:  a)  At 3250 Sea Horse Circle, Laguna Key, Gulf Shores, Alabama:  On or about February 22, 2021 and at times prior; the employer  exposed employees to fall hazards in that employees were lifted into the air on the forks of a powered industrial truck to access a roof exposing employees to a fall hazard of up to 30 feet to the ground below.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   a)  At 3250 Sea Horse Circle, Laguna Key, Gulf Shores, Alabama:  On or about February 22, 2021 and at times prior; the employer allowed his employees to perform roofing activities without first ensuring his employees were trained on the hazards associated with falls to include but not limited to setting up and inspecting fall protection exposing his employees to a fall hazard of up to 30 feet to the ground  below.
