29 CFR  1910.134(a)(2):A respirator was not provided by the employer to each employee when such equipment was necessary to protect the health of the employee:  On or about January 25, 2021, and at times prior to, employees engaging in pharmacy operations were provided with non-medical grade surgical masks instead of the required N95 NIOSH-certified filtering facepiece respirator and were not required to wear approved respiratory protection. At minimum, a N95 NIOSH-certified filtering facepiece respirator is necessary to protect employees from aerosolized SARS-CoV-2 virus.
