29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with the standards set forth in 29 CFR 1926 as evidenced by the violation(s) noted during the course of the inspection. On or about February 24, 2021 and times prior thereto, the controlling contractor and site Project Manager did not maintain programs such as frequent inspections and corrective actions to provide a workplace were workers employed in the performance of the contract were free from recognized hazards on the construction site: a) workers installing wooden framing materials on a commercial building at approximately 14 feet were working without fall protection, and b) workers using pneumatic nail guns to install framing material were not wearing eye protection from flying objects.
