29 CFR 1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets. On or about October 30, 2020, during the installation of exterior surfacing material (brick veneer) at the job site located at 10900 Euclid Ave, Cleveland, Ohio 44106 (Case Western University, A. W. Smith Building 2102); the employer did not ensure employees working on or below a tubular welded framed scaffold utilized protective helmets to protect the employees from fall objects such as tools, brick material, power tools, buckets of mortar. The employees were exposed to 7 sections of, 4 feet long by 1 foot wide (Lime Stone) cap stones that fell from the top of a wall above the employees work location after they had been undercut and not supported.

29 CFR 1926.451(h)(1):Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects. For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall. On or about October 30, 2020, during the installation of exterior surfacing material (brick) at the job site located at 10900 Euclid Ave, Cleveland, Ohio 44106 (Case Western University, A. W. Smith Building 2102); the employer did not ensure employees working on or below a tubular welded framed scaffold were protected from fall objects. The employees were exposed to 7 sections of, 4 feet long by 1 foot wide (Lime Stone) cap stones fall from the top of a wall above after they had been undercut and not supported.
