29 CFR 1910.178(p)(1): A powered industrial truck was found to be in need of repair, defective, or unsafe and was not taken out of service until it had been restored to safe operating condition. On or about 2/23/2021, The Greenbrier Companies, LLC DBA The Greenbrier Companies, had not ensured any powered industrial truck which was found to be in need of repair, defective, or in any way unsafe, was removed from service. The following forklifts were in use and not removed from service: a) Nissan Forklift, Model MUGL02A30LV. The forklift was defective at the time of the inspection; it had an unserviceable LPG locator/indexing pin and was missing a brake pad for the pedal. The pedal had bare metal exposed. b) Nissan, Model 80. The forklift was missing LPG locator/indexing pin and the tank was improperly installed. The forklift was missing a pad on the accelerator pedal; the paint was worn off and bare metal was exposed.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, was not guarded. The guarding device was not in conformity with any appropriate standards therefore, or, in the absence of applicable specific standards, was so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. On or about 2/23/2021, employees at The Greenbrier Companies, LLC DBA The Greenbrier Companies, were exposed to point of operation hazards. The following machines did not have guards or constructed/designed to prevent struck-by or caught-in-between hazards: a) Accurpress 400 Ton Press, Model 740014; the press had a light curtain in lieu of a machine guard; the light curtain was inoperable/defective. b) And, Standard Industrial Corp. 400 Ton Press Brake, Model J0040, the press had a light curtain in lieu of a machine guard; the light curtain was inoperable/defective.
