29 CFR  1910.134(e)(1):  The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  Worksite, 430 Schooleys Mountain Road, Hacketstown, NJ  a) On or about 12/24/2020 to 01/06/2021, the employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring the use. The employer required employees including  RNs,  LPNs, and  CNA s  to wear respirators while providing care to suspected and confirmed positive COVID-19 patients.    The violation occurred on or about 12/24/2020 and after.

29 CFR  1910.134(f)(2):  Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator:  Worksite, 430 Schooleys Mountain Road, Hacketstown, NJ  a) On or about 12/24/2020 to 01/06/2021 the employer did not provide a fit test to all employees required to wear respirators. The employer required employees including RNs, LPNs, and CNA s  to   to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 patients.   The violation occurred on or about 12/24/2020 and after.

29 CFR  1904.4(a):  The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent:    Worksite, 430 Schooleys Mountain Road, Hacketstown, NJ  The employer did not record cases with days away from work for employees diagnosed with COVID-19 related illness and lost work time on the OSHA 300 Log for calendar year  2020 and 2021 to include but not limited to:  a) On or about 12/28/2020 the employer failed to record the COVID-19 positive illness of a Nurses Assistant / Certified Home Health Aide who tested positive for COVID-19 on 12/21/2020.  b) On or about 12/28/2020 the employer failed to record the COVID-19 positive illness of a Nurses Assistant / Certified Home Health Aide who tested positive for COVID-19 on 12/21/2020.  c) On or about 12/31/2020 the employer failed to record the COVID-19 positive illness of a Nurses Assistant / Certified Home Health Aide who tested positive for COVID-19 on 12/24/2020.   d) On or about 1/6/2021 the employer failed to record the COVID-19 positive illness of a Nurses Assistant / Certified Home Health Aide who tested positive for COVID-19 on 12/30/2020.      e) On or about 1/14/2021 the employer failed to record the COVID-19 positive illness of a Resident Services Attendant who tested positive for COVID-19 on 1/7/2021.      f)  On or about 2/10/2021 the employer failed to record the COVID-19 positive illness of a Certified Nurses Assistant who tested positive for COVID-19 on 2/3/2021.     g) On or about 2/11/2021 the employer failed to record the COVID-19 positive illness of a RN Nurse  who tested positive for COVID-19 on 2/04/2021.       Violation occurred on or about 12/28/2020 and after.
