29 CFR 1915.12(a)(1)(v):The employer did not ensure that spaces containing materials or residues of materials that create an oxygen-deficient atmosphere were visually inspected and tested by a competent person to determine the atmosphere's oxygen content prior to initial entry into the space by an employee: On or about 02/21/2021, on the Mississippi river, employees were entering grain barges to conduct power washing cleaning prior to atmospheric testing being conducted in the space.

29 CFR 1915.77(c):- When employees were working aloft, or elsewhere at elevations more than 5 feet above a solid surface, either scaffolds or a sloping ladder, meeting the requirements of Subpart E- Scaffolds, Ladders, and Other Working Surfaces, were not provided to afford safe footing, or the employees shall be protected by safety belts and lifelines meeting the requirements of 1915.159 and 1915,160: On or about 02/21/2021, on the southwest side of a barge on the Mississippi River, employees performed barge cleaning activities at a height more than five feet above a solid surface without appropriate fall protection.
