29 CFR 1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: a) On February 24, 2021, and at times prior thereto; employees were exposed to chemicals, such as but not limited to hydraulic oil 68, weld cleaning fluid and neutralizing fluid for stainless steel cleaners, without the employer having implemented a full, written hazard communication program that included training and proper labeling of said chemicals. Note: Abatement certification is required for this item.

29 CFR 1910.1200(f)(8): The employer did not ensure that portable containers into which hazardous chemicals were transferred from labeled containers and which were not intended for the immediate use of the person doing the transfer, were properly labeled. a) On February 24, 2021; chemicals, such as but not limited to hydraulic oil 68, weld cleaning fluid and neutralizing fluid for stainless steel cleaners, were in the workplace in secondary containers (Folgers coffee can, Ziploc container and an unmarked spray bottle) without proper labeling to identify the substance in the container.
