29 CFR 1926.20(b)(2):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person: (a)D&D Custom Builders, LLC at 305 South Granite Avenue, Tea, SD 57064: On or about and at times prior to February 24, 2021, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were exposed to fall hazards while installing wood trusses with no fall protection systems in place while employees were working from top plates. The condition exposed employees to a fall hazard greater than 10 feet. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

Employees were setting trusses on a residential property while working on the top plates of the exterior walls and no fall protection in place. This condition exposed employees to fall hazards of over 10 feet.

Employees were utilizing the top step of the seven foot Keller A-Frame Fiberglass ladder, model # 777 to access the upper level of the residential property to conduct framing operations. This condition exposed employees to fall hazards associated with utilizing the top step of the seven foot ladder to access the 10 foot top plates.
