29 CFR 1926.102(a)(2): The employer did not ensure that each affected employee used eye protection that provided side protection when there is a hazard from flying objects:  Commercial construction site: On or about February 25, 2021, and at times prior thereto, workers were exposed to a struck-by flying projectile hazard, while using a Dewalt Pneumatic Nail Gun without safety glasses.

29 CFR  1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  Commercial construction site: On or about February 25, 2021, an employee was exposed to a fall hazard while working from a Genie S-85X (Serial # S8513�10556) without a fall arrest system.

29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   Commercial construction site: On or about February 25, 2021, and at times prior thereto, employees were exposed to a fall hazard greater than 6 feet to the unpaved ground below, while working on the canopy area without a fall arrest system.
