29 CFR 1910.23(c)(11):(11) Portable ladders used to gain access to an upper landing surface have side rails that extend at least 3 feet (0.9 m) above the upper landing surface. On or about February 25, 2021, and at times prior thereto, employee operating Werner extension ladder that did not extend at least three feet above the upper landing surface, exposing employee to a fall hazard.

29 CFR 1910.23(b)(10):(10) Any ladder with structural or other defects is immediately tagged "Dangerous: Do Not Use" or with similar language in accordance with �1910.145 and removed from service until repaired in accordance with �1910.22(d), or replaced. On or about February 25, 2021, and at times prior thereto, employees were utilizing a Werner extension ladder that was damaged. The ladder was missing the entire sliding extension ladder and the footings of the remaining ladder were damaged, exposing employees to a fall hazard.
