29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. On February 28, 2021 at 2642 Orion Trail in Green Bay, Wisconsin, employees were working on a roof surface eleven and one half feet above surface level without utilizing fall protection equipment.

29 CFR 1926.503(a)(2)(iii): The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used. On February 28, 2021 at 2642 Orion Trail in Green Bay, Wisconsin, the employer did not provide required fall protection safety training for employees exposed to fall hazards greater than six feet while installing roof sheathing materials.

On February 28, 2021 at 2642 Orion Trail in Green Bay, Wisconsin, employer did not ensure the forklift operator was evaluated at least every three years prior to moving roofing materials with Skytrak 8042 Telehandler up to an eave edge.
