29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. On or about February 26, 2021 and times prior thereto, at a worksite located at 500 E. Loop 820 Fort Worth, Texas, contractor Pappas Roofing and Construction in control of the contract work did not conduct hazard and accident prevention inspections and corrective actions to safety deficiencies such as but not limited to sub contractor employees in plan view exposed to fall hazards of approximately 18 feet to ensure their safety.
