29 CFR 1910.147(c)(4)(ii)(D): The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following: (D): Specific requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control measures. a) On or before 2/23/2021 the employer did not provide effective energy control procedures that included testing and positioning procedures ensuring that employees understood the procedures for testing and securing energy sources for machinery such as but not limited to Stacker #1.

29 CFR 1910.147(c)(7)(i)(A):Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control. On or before 2/23/2021 the employer did not provide each authorized employee the training necessary to recognize the hazardous energy sources and how to conduct testing and positioning and secure energy source for machinery such as but not limited to Stacker #1.

29 CFR 1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence: (1) authorized employee shall have knowledge of the type and magnitude of the energy, the hazards of the energy to be controlled, and the method or means to control the energy. (2) turn off and shut down the machine (3) physically locate and operate the energy isolating devices in such a manner as to isolate the machine or equipment from the energy sources. (4) affix lockout or tagout devices to each energy isolating device (5) Prior to starting work on machines that have been locked out or tagged out, verify that isolation and deenergizing of the machine or equipment have been accomplished. On 2/23/2021 a maintenance employee was diagnosing why no power was going to the rollers on Stacker #1. The employee had the cover off of the energized disconnect box while making adjustments to the tension of the belt drive. During testing the tension on the belt, the employee's leg came in contact with activation button, the machine activated and pulled employee's right hand through the belt.
