An employee was exposed to fall hazards when climbing scaffold frames to get to the work platform approximately 11 feet from grade.   Violation occurred February 26, 2021

29 CFR  1926.501(b)(1):  Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not  protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  Worksite, 37 Keller Ave., Rockaway, NJ  a) Employees were performing masonry construction at the edge of the building's rooftop with a 13 foot fall hazard without any means of fall protection. 29 CFR  1926.602(c)(1)(vi):  Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks:  Worksite, 37 Keller Ave., Rockaway, NJ  a) The employer did not ensure that the employee operating the powered industrial truck used on site complied with all applicable requirements as defined in the ANSI  B56.1-1969, including but not limited to lowering any load, applying the brake, and turning off the machine prior to exiting the powered industrial truck.  The operator of the JLG 10054 Skytrak LULL lifted a pallet of masonry block approximately 17 feet at approximately 40 degrees of pitch and then exited the vehicle leaving the load elevated.  ANSI B56.1-1969, Safety Standards for Powered Industrial Trucks, requires that when leaving a Powered Industrial Truck unattended, load engaging means shall be fully lowered, controls shall be neutralized, power shut off, brakes set, and the key or connector plug removed.   Violation occurred on or about March 3, 2021.
