29 CFR 1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level: (a) Jobsite, Exterior Fire Escape Platforms: On or about February 2, 2021, an employee was walking/working from the 8th floor exterior fire escape platform of the building and the guardrail system on this platform was only 35 1/2 inches high. The fall hazard to the employee was up to about 115 feet.

29 CFR 1926.1053(a)(15):The minimum perpendicular clearance between the centerline of fixed ladder rungs, cleats, and steps, and the unavoidable obstruction on the climbing side of the ladder was less than 24 inches (61 cm): (a) Jobsite: On or about February 2, 2021, an employee was using the fixed ladder from the 8th floor exterior fire escape to access the roof and the bottom 3 rungs of this ladder were within 24 inches of the exterior fire escape platform railing.

29 CFR 1926.1053(a)(18):Where the length of climb on a fixed ladder was less than 24 feet (7.3 m) and the top of the ladder was at a distance greater than 24 feet (7.3 m) above lower levels, the ladder was not provided with either a cage, well, ladder safety devices or self-retracting lifelines: (a) Jobsite: On or about February 2, 2021, an employee used a fixed ladder from the platform of the 8th floor exterior fire escape to access the roof and there was no cage, well, ladder safety devices nor self retracting lifelines on this ladder. The employee was not tied off as he accessed the roof, but he did partially tie off (he had to unhook because of a break in the handrail) to the ladder handrail when he egressed the roof to the 8th floor exterior fire escape platform. The fall hazard to the employees was about 120 feet to the asphalt alley below.
