29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part.  a) OZ Construction LLC on or about March 4, 2021, at the address of 1050 Medical Center Pkwy, Maumee, OH: The employer did not have a plan or program to identify job site hazards, which assist employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards, such as falls during job site operations, decreasing the probability of employee injury and/or illness.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.   a) OZ Construction LLC on or about March 4, 2021, at the address of 1050 Medical Center Pkwy, Maumee, OH: The employer had not trained employees in the appropriate use of fall protection, such as but not limited to, the use of personal fall arrest systems while performing various roofing operations. The employees did not recognize the hazards associated with working from an elevated location of 25 ft. without the benefit of fall protection.

29 CFR 1926.501(b)(11): Each employee engaged in roofing activities on a steep roof, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems:  a) OZ Construction LLC on or about March 4, 2021, at the address of 1050 Medical Center Pkwy, Maumee, OH: The employer did not ensure employees were protected from falls while performing roofing activities atop a steep-sloped commercial structure. The employees were exposed to a potential 25 ft. to the ground below.

29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension was not possible because of the ladder's length, then the ladder was not secured at its top to a rigid support that will not deflect, and a grasping device, such as a grab rail, was not provided to assist employees in mounting and dismounting the ladder.  a) OZ Construction LLC on or about March 4, 2021, at the address of 1050 Medical Center Pkwy, Maumee, OH: The employer did not ensure the side rails of 30 ft. aluminum extension ladders used onsite were extended at least three feet above the landing surface. Seven employees were exposed to a near 25' fall to the level below while performing roofing activities using the ladder to access the south side of the commercial structure roof.
