29 CFR 1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. At the construction site at the Northeast corner of FM-521 and Southbelt Industrial Drive, on or about March 3, 2021, employees working in a congested space near heavy moving material handling equipment such as, but not limited to, excavators, front end loaders, and bulldozers, were exposed to struck-by hazards from the movement of the equipment because the alleged designated spotter was not properly instructed in the avoidance of unsafe conditions.
