29 CFR  1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about March 3, 2021, and at times prior, the employer did not initiate and maintain safety and health programs to ensure their employees were protected from the hazards associated with residential framing construction. Employees were working from heights without fall protection and utilizing power tools without proper eye protection. As a result, employees were exposed to hazards such as, but not limited to, falls from heights and struck-by hazards associated with the residential framing activities.

29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. On or about March 3, 2021, and at times prior, an employee was operating a portable circular saw and pneumatic nail gun without the use of eye protection. The employee was thereby exposed to struck-by hazards associated with flying particles.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. On or about March 3, 2021, and at times prior, employees were engaged in framing activities above 6 feet without the use of fall protection measures. An employee was installing sheathing on the roof of a residential structure without the use of fall protection measures and was thereby exposed to falls from heights of approximately 18 feet.

Suitability of equipment for an identified purpose may be evidenced by listing, labeling, or certification for that identified purpose.  a. On or about March 3, 2021, and at times prior, a relocatable power tap was utilized with extension cords plugged into it with accompanying power tools. This relocatable power tap was not utilized in accordance with its listing and labeling purpose. Employees were thereby exposed to electrical fire hazards.
