29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Rimo Construction, LLC, at a jobsite located at 4502 Ruppert Trail, Lot 3798, Powell, Ohio 43065: On and/or preceding March 5, 2021, the employer failed to ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Employees were using a pneumatic nail gun and circular saw while framing a house. The employees were not utilizing eye protection, thereby exposing employees to struck-by hazards to the eyes.

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a) Rimo Construction, LLC, at a jobsite located at 4502 Ruppert Trail, Lot 3798, Powell, Ohio 43065: On and/or preceding March 5, 2021, the employer did not ensure portable ladders that were used for access to an upper landing surface were extended at least 3 feet (.9 m) above the upper landing surface. Employees were using extension ladders that did not extend at least 3 feet above the edge of the roof, thereby exposed to fall hazards of up to 12 feet 8 inches.

29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) Rimo Construction, LLC, at a jobsite located at 4502 Ruppert Trail, Lot 3798, Powell, Ohio 43065: On and/or preceding March 5, 2021, the employer failed to initiate and maintain a safety and health program such as but not limited to a personal protective equipment program, a fall protection program, and a ladder safety program, thereby exposing employees to struck-by hazards and fall hazards of up to 12 feet 8 inches.  Rimo Construction LLC was previously cited for a violation of this occupational safety and health standard 29 CFR  1926.20(b)(1), which was contained in OSHA inspection number 1477937, citation number 1, item number 1 and was affirmed as a final order on August 24, 2020, with respect to a workplace located at 5736 Butternut Drive, Lewis Center, OH 43035.

29 CFR  1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a) Rimo Construction, LLC, at a jobsite located at 4502 Ruppert Trail, Lot 3798, Powell, Ohio 43065: On and/or preceding March 5, 2021, the employer failed to train employees on the hazards found on the worksite or the procedures to control or eliminate the hazards for employees conducting framing work.  Rimo Construction LLC was previously cited for a violation of this occupational safety and health standard 29 CFR  1926.20(b)(1), which was contained in OSHA inspection number 1477937, citation number 1, item number 2 and was affirmed as a final order on August 24, 2020, with respect to a workplace located at 5736 Butternut Drive, Lewis Center, OH 43035.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a) Rimo Construction, LLC, at a jobsite located at 4502 Ruppert Trail, Lot 3798, Powell, Ohio 43065: On and/or preceding March 5, 2021, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees were framing the roof without any means of fall protection, thereby exposed to fall hazards of up to 12 feet 8 inches.  b) Rimo Construction, LLC, at a jobsite located at 4502 Ruppert Trail, Lot 3798, Powell, Ohio 43065: On and/or preceding March 5, 2021, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees were framing the house with an unguarded basement opening, thereby exposed to fall hazards of up to 10 feet 3 inches.  Rimo Construction, LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1477937, citation number 1, item number 3, and was affirmed as a final order on August 24, 2020, with respect to a workplace located at 5736 Butternut Drive, Lewis Center, OH 43035.
