OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being struck-by frontend loaders/ earth moving equipment. On or about February 24, 2021, employees were walking in front of/ alongside of a frontend loader/ earth moving equipment to guide/ maneuver a palm tree which was suspended by/ being moved by the frontend loader; therefore exposing the employees to a struck-by hazard.
