29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about March 8, 2021 employees engaged in residential roofing operations were exposed to struck-by hazards while operating nail guns without eye protection.  No abatement certification or documentation required for this item.

29 CFR  1926.451(f)(7):Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person.  On or about March 8, 2021, the employer failed to ensure that the ladder jack scaffold was erected by a competent person. This exposed employees to fall hazards of 22 feet when working on the scaffold.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.452(k)(1):Platforms shall not exceed a height of 20 feet (6.1 m).  On or about March 8, 2021, the employer failed to ensure that the ladder jack scaffold platform did not exceed 20 feet in height. Employees were exposed to fall hazards due to the ladder jack scaffold platform being set up 22 feet.    Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    On or about March 8, 2021, employees were exposed to fall hazards approximately 24 feet high while engaged in residential roofing activities.  Fall protection was not being utilized while performing roofing operations.       No abatement certification or documentation required for this item.

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders shall be used at an angle such that the horizontal distance from the top support to the foot of the ladder is approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support).   On or about March 8, 2021, employees used an extension ladder at an angle such that the horizontal distance from the top support to the foot of the ladder (approximately 22 feet) is more than one-quarter of the working length of the ladder (approximately 9 feet).  Abatement documentation is required of this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.  On or about March 8, 2021, the employer failed to certify that employees had been trained to recognize and minimize fall hazards.  Employees were exposed to fall hazards approximately 24 feet while performing roofing activities on a residential structure without using fall protection.    Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
