29 CFR 1910.27(a): The employer did not ensure that scaffolds used in general industry meet the requirements in 29 CFR part 1926, subpart L (Scaffolds): a. On or about March 8, 2021, at the above addressed jobsite, an employee changing messages on a storefront sign while raised over ten (10) feet above ground level on a wood pallet by the forks of a Yale ERP040 Electric Forklift, was not protected from falling, thereby exposing the employee to a fall of greater than 10 feet. The scaffold (i.e., wood pallet attached to the forks of the forklift) did not meet the requirements of 29 CFR part 1926, subpart L.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a. On or about March 8, 2021, at the above addressed jobsite, employees were required to operate a Yale ERP040 Electric Forklift without being provided training including, but not limited to, formal instruction, practical training and an evaluation of the operator's performance, thereby exposing employees to struck-byhazards.
