29 CFR 1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: (a) On or about March 8, 2021, employees painting the exterior of a retail building from a SkyJack SJ45T (Model No. SJ 45T & Serial No. 98003364) aerial lift were not protected from an approximate 12 foot fall/thrown hazard, by using a safety harness and lanyard attached to the lift.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. (a) On or about March 8, 2021, employees painting the exterior of a retail building from a SkyJack SJ45T (Model No. SJ 45T & Serial No. 98003364) aerial lift, had not been trained on the hazards associated with scaffold work and how to mitigate those hazards. This exposed employees to an approximate 12 foot fall/thrown hazard.
