29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers: a) The Railyard Townhouses at the University of Delaware: On or about March 9, 2021, the employer failed to initiate and maintain a program of frequent and regular inspections made by a person competent in safety and health regulations and hazards recognition for the construction industry which resulted in hazardous conditions at the site including , but not limited to fall hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): a) The Rail Yard Townhouses Newark, DE: On or about March 9, 2021, the employer failed to ensure their employees, conducting residential framing activities approximately 8 to 12 feet above grade were provided fall protection; a safety net system, and/or a personal fall arrest system. b) The Rail Yard Townhouse at the University of Delaware: On or about March 9, 2021, the employer failed to ensure that their employees placing bundles of asphalt shingles on the roof of the residential townhomes approximately 20 to 30 feet above grade were provided fall protection; a safety net system, and/or a personal fall arrest system.
