29 CFR  1910.147(c)(4)(ii): The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following:   On or about March 03, 2021, documented procedures in the employer's lockout/tagout program did not adequately outline the scope, purpose, authorization, rules, and techniques to be utilized for the prevention of unexpected energizing, start-up or release of stored energy on all company machines, to include the Guifil Hydraulic press #2. Employees who gained access to equipment during cleaning, servicing, setup and maintenance were exposed to caught-in hazards.   Abatement certification is required for this item in accordance with 29 CFR 1903.19(c).

29 CFR  1910.147(c)(6)(i):The employer shall conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed.  On or about March 03, 2021, the employer did not conduct a periodic inspection of the energy control procedures at least annually to ensure that the procedures and the requirement of this standard were being followed. Employees utilizing undocumented procedures were exposed to caught-in hazards and struck-by hazards.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR  1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence:   On or about March 03, 2021, prior to starting work on the machines, to include the setup of the Diacro Press brake machine, employees were not required to apply hazardous energy controls as follows:   1. Prepare for shut down by recognizing energy hazards and its controls, 2. Turn off and shut down the machines, 3. Physically locate and operate energy isolating devices in such a manner as to isolate the machine or equipment from the energy source, 4. Affix lockout or Tag-out devices to each energy isolating device, 5. Render safe all potentially hazardous stored or residual energy, 6. Verify that isolation and de-energization of the machine or equipment have been accomplished.  The employer failed to take the necessary steps to ensure that their employees were properly protected against caught-in and amputation hazards from unexpected start-up. Hazardous energy controls (Lockout) were not implemented and performed to protect the employee from the caught-in hazard, likely to result in amputation.  Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d)

29 CFR  1910.212(a)(3)(ii):The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.  a. On or about  February 26, 2021, an employee sustained an amputation injury while operating the Cell 2 Guifil Press Brake S/N 013604, where the employer did not provide sufficient forms of guarding to prevent the operator from gaining access to the pinch point created between dies at the point of operation. 29 CFR  1910.147(c)(5)(i):Locks, tags, chains, wedges, key blocks, adapter pins, self-locking fasteners, or other hardware shall be provided by the employer for isolating, securing or blocking of machines or equipment from energy sources.  On or about March 03 2021, Tags and/or other hardware were not provided by the employer for isolating, securing or blocking of machines or equipment from energy sources, including electrical, mechanical, hydraulic and pneumatic. This exposed employees to hazards capable of causing amputation.     Abatement documentation is not required for this item.
