29 CFR 1910.119(h)(3)(ii): The contract employer did not ensure that each contract employee was instructed in the known fire, explosion, or toxic release hazards related to his/her job and the process, and the applicable provisions of the emergency action plan: On or about February 27, 2021, in the process area that includes Unit 6 and Unit 9 of the Lion Oil Refinery in El Dorado, Arkansas, workers were exposed to fire, explosion and toxic release hazards when the contract employer did not inform its employees of the hazard of disturbing process piping by allowing heavy vehicles to strike the process piping structure routed in the roadway between the units. (a) Contract employee drove forklift over the process piping. (b) Contract employee drove small crane over the process piping. (c) Contract employee drove tractor and exchanger bundle dolly into the process piping structure.

29 CFR 1910.119(h)(3)(v): The contract employer did not advise the employer of any unique hazards presented by the contract employer's work, or of any hazards found by the contract employer's work: On or about February 27, 2021, in the process area between Unit 6 and Unit 9 of the Lion Oil Refinery in El Dorado, Arkansas, workers were exposed to fire, explosion and toxic release hazards when the contract employer did not communicate with the Operations Group of Units 6 and 9 to inform them of the intent to cross the piping on A Street with heavy vehicles and did not advise the employer of the hazard of vehicle interference with or influence on the process.
