29 CFR 1910.28(b)(1)(i):29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): On or about March 15, 2021 the employer failed to ensure that employees were protected from falls greater than 4 feet to the level below. Guardrails were not in place at the active loading dock area near the rebar bending equipment. Employees were exposed to a fall height of approximately 4 1/2 feet.

Employees perform varied tasks at the facility which can require the use of PPE. The employer provides PPE for employee use but had not performed an overall assessment.

On or about March 15, 2021 the employer failed to ensure that slings used in the workplace contain legible markings with required identification. 29 CFR 1910.184(d):Each day before being used, the sling and all fastenings and attachments were not being inspected for damage or defects by a competent person designated by the employer: On or about March 15, 2021 the employer failed to ensure that slings were inspected prior to use. Slings used in the work area including synthetic slings, chains, and wire ropes contained damage and defects as well as missing identification markings. An inspection prior to use would have revealed these discrepancies.

29 CFR 1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about March 15, 2021 the employer failed to ensure that effective machine guarding was in place on the Schnell Syntax 25. Employees are exposed the the moving machine parts of the rebar rollers and dies as well as the movement of the table and finished production pieces. The employer did not ensure employees were located outside of the hazardous area as indicated in the owner's manual for the equipment.
