29 CFR 1926.300(b)(2): Moving part(s) of equipment exposed to contact by employees or which otherwise created a hazard, were not guarded: New townhome construction located on Lots #47-49 Aldworth Place, Marietta, GA 30067, Front side of townhomes: On or about 03/11/2021, the employer exposed employees to caught-by/amputation hazards while operating an Multi-Quip (Model MC-64S) Trailer Concrete Mixer, in that the cover of the starter recoil was missing and the motor guard was missing exposing operators to moving parts.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. New townhome construction located on Lots #47-49 Aldworth Place, Marietta, GA 30067, Back side of townhome: On or about 03/11/2021, the employer exposed employees to fall hazards of up to 27-feet to the lower level, in that mid rails and end rails were not provided or installed in locations where employees were installing bricks on a tubular welded scaffold system platforms. Moises Castelan Vera was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1), which was contained in OSHA inspection number 1492301, citation number 1, item number 3 and was affirmed as a final order on 02-17-2021, with respect to a workplace located at 3470 Clairmont Road, Atlanta, GA 30310.
