29 CFR 1926.1204(e)(1)(ii): When entry was authorized, continuous monitoring of entry conditions in the areas where authorized entrants were working was not done:  a) Digester Tank #3: On March 9, 2021 and at times prior thereto controlling employer employees and sub-contractor employees performed sludge removal activities in a 34 foot high, 50 foot diameter waste water treatment digester tank. A single Honeywell Gas Alert MAX XTII air quality monitor was used; hung approximately 15 feet above the area where the authorized entrants were working.   Note) Certification of corrective action is required for this item.

29 CFR  1926.1207(a): The employer did not provide training to each employee whose work was regulated by this standard, at no cost to the employee, and ensure that the employee possessed the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under this standard. This training must result in an understanding of the hazards in the permit space and the methods used to isolate, control or in other ways protect employees from these hazards, and for those employees not authorized to perform entry rescues, in the dangers of attempting such rescue:  a) Jobsite, digester tank #3: On March 9, 2021 and at times prior thereto the employer did not ensure that their employees who enter and work in permit-required confined spaces and non-permit confined spaces had been provided with the training needed to recognize hazards within a space and to know how to effectively use monitoring devices and  control methods.  Employees entered and performed sludge removal activities in a waste water treatment digester tank.       Note) Corrected during inspection.
