29 CFR 1926.1204(e)(1)(ii): When entry was authorized, continuous monitoring of entry conditions in the areas where authorized entrants were working, was not done:  a) Digester tank #3: On March 9, 2021 and at times prior thereto employees performed cleaning activities in a 34 foot high, 50 foot diameter waste water treatment digester tank.  A single Honeywell Gas Alert MAX XTII monitor was used for continuous air monitoring.  It was located approximately 15 feet above the area where the authorized entrants were working.   Note) Certification of corrective action is required for this item.

29 CFR  1926.1205(f): The entry employer did not retain each canceled entry permit for at least 1 year in order to facilitate a review of a permit-required confined space program required by �1926.1204(n):  a) On March 9, 2021 and at times prior thereto the employer did not acquire or maintain cancelled confined space entry permits from the host or controlling employer's they had worked with, as part of a permit -required confined space program, and in order to review any problems noted during the entry so corrective actions could be taken if needed to ensure the safety and health of their employees.  Credence Clearwater Industrial employees entered and performed sludge removal activities in a waste water treatment digester tank under a confined space entry permit generated and maintained by the controlling employer.     Note) Certification of corrective action is required for this item.

29 CFR  1926.1207(a): The employer did not provide training to each employee whose work is regulated by this standard, at no cost to the employee, to ensure that the employee possessed the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under this standard. This training must result in an understanding of the hazards in the permit space and the methods used to isolate, control or in other ways protect employees from these hazards, and for those employees not authorized to perform entry rescues, in the dangers of attempting such rescue  a) On March 9, 2021 and at times prior thereto the employer had not developed or implemented their own employee training program for confined space, permit required confined space, and confined space entry.  The employer did not provide training for their employees that could then be supplemented, as needed, by a host or controlling employer to identify specific hazards and control methods unique to the jobsite and space being entered.  Employees performed sludge removal activities in a waste water treatment digester tank.    Note) Certification of corrective action is required for this item.
