29 CFR 1910.1200(e)(1)(i): The employer did not compile a complete list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet. a) DECA Commissary (1588 Mall Drive, Norfolk, VA 23511): On or about 03/16/2021 and times prior thereto, the employer did not ensure that all products, containing hazardous chemicals and used routinely by employees for COVID-19 sanitation procedures, were listed in the employer's hazardous chemical inventory list. The missing products containing hazardous chemicals included disinfecting wipes, Fabuloso cleaner, and Lysol general purpose cleaner. The disinfecting wipes contained sodium hypochlorite. The Fabuloso cleaner contained alkylbenzenesulfonic acid. The Lysol general purpose cleaner contained dodecyldimethylamine oxide and quaternary ammonium compounds. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employee(s) and their representatives were informed of this abatement.

29 CFR 1910.1200(f)(6)(ii): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical. a) DECA Commissary (1588 Mall Drive, Norfolk, VA 23511): On or about 03/16/2021 and times prior thereto, employees were operating secondary containers of hazardous cleaning chemicals, specifically Fabuloso cleaning solution containing alkylbenzenesulfonic acid, without labels containing specific information regarding the physical and health hazards of the hazardous chemical. b) DECA Commissary (1588 Mall Drive, Norfolk, VA 23511): On or about 03/16/2021 and times prior thereto, employees were operating secondary containers of hazardous cleaning chemicals, diluted bleach spray solution containing sodium hypochlorite, without labels containing specific information regarding the physical and health hazards of the hazardous chemical. c) DECA Commissary (1588 Mall Drive, Norfolk, VA 23511): On or about 03/16/2021 and times prior thereto, employees were operating secondary containers of hazardous cleaning chemicals, Lysol general purpose cleaner containing dodecyldimethylamine oxide and quaternary ammonium compounds, without labels containing specific information regarding the physical and health hazards of the hazardous chemicals. 29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical. a) DECA Commissary (1588 Mall Drive, Norfolk, VA 23511): On or about 03/16/2021 and times prior thereto, the employer did not ensure that all Safety Data Sheets, associated with the cleaning chemicals used at their facility, were available and up-to-date. All safety documents in DECA's chemical inventory binder were Material Safety Data Sheets, printed prior to the 2012 29CFR 1910.1200 update. Also, the disinfecting wipes, Lysol, and Fabuloso cleaning products used routinely onsite did not have associated Safety Data Sheets in the chemical inventory binder. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employee(s) and their representatives were informed of this abatement.
