29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: (a) Hotel Main Roof - An employee used a leaf blower to blow roofing debris off the roof, and employees used pneumatic nailers to install new roofing materials. The employees did not use any eye protection, exposing them to the hazard of getting struck in the eyes by flying particles/objects, on or about March 17, 2021. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill: (a) Hotel Main Roof - Employees worked on the main roof and dormers, which all had a 6 in 12 slope. These employees worked with no protection from falling four stories to the ground below, on or about March 17, 2021. No abatement certification or documentation required. (b) Pool Roof - Two employees worked on the pool roof, which had a 6 in 12 slope. These employees worked with no protection from falling to the ground below, on or about March 17, 2021. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.602(c)(1)(vi): Industrial trucks in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks, as follows: the load engaging means was not fully lowered when leaving a powered industrial truck unattended: (a) Parking Lot behind the Hotel - The rough terrain forklift operator placed a debris hopper on the forks of the rough terrain forklift and elevated the forks of this lift to the roof level of the building. The operator of this lift dismounted and did not have the load engaging means fully lowered, exposing employees to the hazard of a falling or dropped load, on or about March 17, 2021. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
