29 CFR  1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  (a) At the ultraviolet influent line located near the northeast corner of the jobsite; On or about March 10, 2021, an employee working within an excavation approximately 5 feet 10 inches deep was not provided with effective cave-in protection by means of a system(s) designed in accordance with 29 CFR 1926.652 (b) or (c).

29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:  (a) At the utility vault located southeast of the UV disinfection building; An employee was using a Bosch Model 11304 electric jackhammer to chip concrete without the use of engineering controls to reduce dust emissions as required by Table-1 paragraph (c)(1) of this section.

29 CFR  1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  (a) At the utility vault located southeast of the UV disinfection building; The employer did not conduct an assessment of respirable crystalline silica exposure for an employee who was using a Bosch Model 11304 electric jackhammer to chip concrete without the use of engineering controls to reduce dust emissions as required by Table-1 paragraph (c)(1) of this section.
