29 CFR  1910.147(c)(6)(i)(C):  Where lockout was used for energy control, the periodic inspection did not include a review, between the inspector and each authorized employee, of that employee's responsibilities under the energy control procedure being inspected:  a) Cutting Department - On or about March 18, 2021, an authorized employee performed a die set-up on the J. Bobst & Fils die cutter machine, serial no. 11839.  The employer failed to provide a periodic inspection that included a review between the inspector and each authorized employee and the employee's responsibility under the energy control procedure.

29 CFR  1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):   a.) Cutting Department - On or about  March 18, 2021, an employee was exposed to machine hazards associated with moving parts when a die setup was performed on the J. Bobst & Fils die cutter machine, Serial No. 11839.  The employer failed to implement energy control application steps as the machine was not shut down or turned off to perform the servicing work [per the 1910.147(d)(2) requirements].  As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)((i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards.

29 CFR  1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and   a.) Production - On or about March 15, 2021, the employer failed to provide effective guarding to protect employees working at or near the Baler.  An employee sustained a hand injury while operating the baler when the compressor came down and crushed the employee's left hand, causing the skin to deglove from three fingers.
