29 CFR OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of contracting the virus, SARS-CoV-2 (severe acute respiratory syndrome coronavirus 2), the cause of coronavirus disease 2019 (COVID-19). a) Facility, 301 Corbet Street, Tarentum, PA 15084 On or about February 1, 2, and 3, 2021, the employer did not develop and implement timely and effective measures to mitigate the spread of SARS-CoV-2, the virus that causes Coronavirus Disease 2019 (COVID-19). The employer conducted in-person employee training for a new computer software program at its Corbet Street conference room approximately 371 square feet. At least eight employees and one manager attended each training session for four to six hours per day. The instructors providing the training came in from out of state and did not quarantine or self-screen prior to conducting the training. The employer did not ensure the instructors wore masks while providing the training and that employees wore masks correctly. Following the training, approximately thirteen employees tested positive for COVID-19. b) Facility, 400 Second Avenue, Tarentum, PA 15084 On or about February 1, 2, and 3, 2021, the employer did not develop and implement timely and effective measures to mitigate the spread of SARS-CoV-2, the virus that causes Coronavirus Disease 2019 (COVID-19). The employer conducted in-person employee training for a new computer software program at its Second Ave conference room approximately 442 square feet. At least eight employees and one manager attended each training session for four to six hours per day. The instructors providing the training came in from out of state and did not quarantine or self-screen prior to conducting the training. Following the training, approximately two employees tested positive for COVID-19.
