29 CFR  1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye:  (a)Midwest Dakota Dumpsters, Inc. at 209 South Oak Street, Castlewood, SD 57223:  On or about and at times prior to October 14, 2020 the employer did not report an incident that resulted in an amputation of the left index finger of an employee within 24 hours to OSHA.

29 CFR  1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:   (a)Midwest Dakota Dumpsters,  Inc. at 209 South Oak Street, Castlewood, SD 57223: On or about and at times prior to March 19, 2021, the employer did not ensure employees were protected by struck-by hazards as a result of using front-end attachments. The employer modified the forklift lifting capacity by using forklift extensions to lift  a variety of metal components used in the manufacture of roll-off dumpsters without the written approval from the manufacturer and did not change the associated forklift data plate to indicate the change in lifting capacity. This condition exposed employees to improper forklift operation and struck-by hazards.

29 CFR  1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).   (a)Midwest Dakota Dumpsters,  Inc. at 209 South Oak Street, Castlewood, SD 57223: On or about and at times prior to March 19, 2021, the employer did not ensure all forklift operators were trained in operation of powered industrial truck in that the operators were not trained in the use of the Caterpillar forklift prior to their use.  This condition exposed the employees to the hazard of improper forklift operation.  Abatement Note:  Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.

29 CFR 1910.212(a)(3)(ii):  Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s):  (a)Midwest Dakota Dumpsters, Inc. at 209 South Oak Street, Castlewood, SD 57223:  On or about and at times prior to March 19, 2021, the employer did not ensure multiple points of operation on the Buffalo Ironworker were effectively guarded. Employees were not prevented from having any part of their body in the danger zones during operations involving the shear and punch press. This hazard exposed the employees to an amputation hazard.

29 CFR  1910.303(b)(1):Electrical equipment was not free from recognized hazards that were likely to cause death or serious physical harm to employees, in that the employer did not ensure the safety of the equipment pursuant to the considerations in sections (i) through (viii) of 29 CR 1910.303(b)(1):  (a)Midwest Dakota Dumpsters, Inc. at 209 South Oak Street, Castlewood, SD 57223: On or about and at times prior to March 19, 2021, the employer did not ensure employees were protected from electrical hazards involving the operation of the Buffalo Ironworker. The ironworker had an open electrical box which containing energized 240V A/C electrical circuitry and was missing the cover. This condition exposed the employees to the hazard of electrical shock and burns.

29 CFR  1910.303(b)(2): Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling:  (a)Midwest Dakota Dumpsters, Inc. at 209 South Oak Street, Castlewood, SD 57223: On or about and at times prior to March 19, 2021,  the employer did not ensure that an electrical outlet box was used in accordance with listed instructions. A galvanized metal 4-gang outlet box used in conjunction with PVC electrical conduit was suspended from the ceiling with no support and not properly mounted.   Employees were exposed to electrical shock hazards associated with inappropriate use of the electrical box.
