29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about March 23, 2021, located at 12682 Fancher Road, Lot 24 FR, in Westerville, Ohio, the employer did not initiate and maintain safety and health programs for employees that performed work at heights, climbed ladders, operated nail guns, etc., thereby exposing the employees to the hazards associated with residential framing work.

On or about March 23, 2021, located at 12682 Fancher Road, Lot 24FR, the employer did not instruct employees in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate hazards while employees were performing framing work on a residential home, thereby exposing the employees to the hazards associated with framing work.

29 CFR  1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  a. On or about March 23, 2021, located at 12682 Fancher Road, Lot 24FR, employees were framing the roof of a residential two-story home while there were employees working on the 2nd floor without hardhats, thereby exposing the employees to struck-by hazards.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. On or about March 23, 2021, located at 12682 Fancher Road, Lot 24FR, employees operated pneumatic nail guns without eye protection, thereby exposing the employees to struck-by hazards.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.   a. On or about March 23, 2021, located at 12682 Fancher Road, Lot 24FR, employees were installing roof sheathing on a two-story residential home without any means of fall protection, thereby exposing the employees to a fall hazard of approximately 25 feet.   b. On or about March 23, 2021, located at 12682 Fancher Road, Lot 24FR, there were two window openings  on the second floor of a  two-story residential home without a top rail or any other means to protect employees from falls, thereby exposing the employees to a fall hazard of approximately 15 feet.   c. On or about March 23, 2021, located at 12682 Fancher Road, Lot 24FR on the 1st floor, there was a 7 foot 4 inch by 9 foot floor hole that did not have adequate guardrails or any other means of fall protection to protect employees from falling into the basement, thereby exposing the employees to a fall hazard of 10 foot 4 inches.

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a. On or about March 23, 2021, located at 12682 Fancher Road, Lot 24FR, an extension ladder was used to access to and from the second floor through a window opening. The ladder did not extend at least three feet above the landing surface, thereby exposing the employees to a fall hazard of approximately 15 feet.
