29 CFR OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees in the train were exposed to the hazards of operating a train across an active highway: a) Jobsite located approximately at West 10th Street & Rennie Lane; North side gate of Energy Transfer facility, Marcus Hook Terminal- On or about October 20, 2020, a train engineer and conductor were exposed to hazards while operating a train across an active highway without utilizing measures to ensure the track was clear of obstructions. A train moving southbound struck a manually operated gate in the closed position, and stopped in the middle an active highway, exposing the train carrying train engineer and conductor to struck-by hazards.
